To be an authorized Student Ambassador (an "Ambassador") of Fund My Textbooks, Inc. ("FMT"), you agree to abide by the following terms and conditions.

Please read these terms and conditions carefully before registering and using the Fund My Textbooks service as an Ambassador. By signing up for the Fund My Textbooks Student Ambassador Program, you indicate your acceptance of these terms and conditions and they are binding on you.

1.  Introduction
Student Ambassador Program: The FMT Student Ambassador Program is designed to engage motivated UC Davis students in helping to promote the Fund My Textbooks platform among their peers. Ambassadors will educate fellow students, drive signups, and support the platform's growth - all while earning incentives and gaining real-world marketing experience.

Ambassadors are expected to share information about the FMT platform through their personal networks (including social media, text, email, and in-person outreach), track referrals through their unique sign-up link, and act as enthusiastic representatives of the platform on campus.

2. Eligibility and Registration
Eligibility: Participation is open only to individuals that meet the criteria set by FMT. Ambassadors must complete the registration process and provide accurate, complete information. FMT reserves the right to accept or reject any application at its discretion.

The current criteria to be an Ambassador is set forth below and is subject to change as determined by FMT.
Ambassadors must be currently enrolled undergraduate or graduate students at UC Davis.

Ambassadors must be at least 18 years of age. Students under 18 may be allowed to participate with parental or guardian consent on a case-by-case basis. If you are under 18 years of age, please contact FMT for further information.

3. Ambassador Obligations
Promotion Standards: Ambassadors must use ethical, honest, and transparent practices when promoting FMT's products and services, as determined by FMT. That obligation includes, without limitation, the following:

Ambassadors shall represent FMT professionally and respectfully, using pre-approved messages provided in the Ambassador Toolkit (e.g., sample social media posts, text templates, email samples) and following the Brand Guidelines (as defined, below).

While creativity is encouraged, Ambassadors shall not make misleading or unverified claims about FMT.
Compliance: Ambassadors agree to follow all applicable laws and advertising guidelines, including restrictions on spam, misleading claims, and use of prohibited marketing tactics. Ambassadors will immediately cease any marketing or related activities at the request of FMT.

Brand Guidelines: Ambassadors must adhere to FMT's branding and marketing guidelines when using logos, trademarks, or other intellectual property. A downloadable Brand Guide will be provided to each Ambassador that includes acceptable logo usage, color schemes, and messaging dos and don'ts (the "Brand Guidelines"). Ambassadors may not alter FMT logos, distort branding, or use unauthorized graphics. Logos may only be used in conjunction with promoting approved FMT campaigns or materials.

4. Commission and Payment Terms
Commission Structure: The program offers certain payments and commissions, which are generally based on student activity on the FMT platform or other defined actions, as follows:

The Ambassador will receive a one-time signup bonus of $20 just for signing up to be a FMT Ambassador.
Ambassadors earn $5 when a referred student signs up and creates a live FMT fundraising campaign. A referral is considered valid if the referred student uses the Ambassador's unique tracking link to sign up using their UC Davis email and successfully launches a live campaign.

Ambassadors may earn UC Davis Bookstore gift cards based on the volume of referred students who create live campaigns, as follows:

Milestone - Gift Card Bonus
10 Live Campaigns - $25 Bookstore Gift Card
20 Live Campaigns - $50 Bookstore Gift Card
40 Live Campaigns - $100 Bookstore Gift Card
60+ Live Campaigns - $150 Bookstore Gift Card (Max Tier)

Ambassadors may earn a combined maximum of $600 in cash bonuses and gift cards. Ambassadors who exceed 60 referred live campaigns may be eligible for additional recognition and perks at FMT's discretion.
Payment Schedule: Commissions are payable on a set schedule determined by FMT once a minimum payout threshold is reached, as follows:

The Ambassador signup bonus of $20 will be paid via Venmo.
Commission payments will be made monthly via Venmo, provided that at least $30 in commission has been earned.

Earnings below the threshold will roll over to the next month until the minimum threshold is met.
FMT will purchase Bookstore gift cards online and email the access code.

Ambassadors will need to provide FMT with accurate Venmo payment information to receive payments and are responsible for keeping that information current with FMT. Ambassadors must also complete a Form 1099 for income over $600.
Deductions: FMT reserves the right to withhold or adjust payments in the event of refunds, chargebacks, or suspected fraudulent activity.

Payout Process: To receive commissions, bonuses, and rewards, the Ambassador must have an FMT student account with an active FMT campaign.

Acceptable Referral: Acceptable referrals are only for currently enrolled UC Davis students. Each referral who signs up with FMT must use their UC Davis email and create a live FMT fundraising campaign to qualify. Commissions, bonuses, and rewards will not be given if the referred student is not enrolled at UC Davis, does not use a UC Davis email to sign up, or does not create a live campaign.

5. Intellectual Property
License Grant: FMT grants Ambassadors a limited, non-exclusive, non-transferable, revocable license to use its trademarks, logos, and marketing materials solely for the purpose of promoting its products and services, subject to the Brand Guidelines. FMT may revoke that license at any time, in which case the Ambassador must immediately cease using all FMT logos and other materials and immediately delete or otherwise remove any FMT logos or other materials previously posted or made publicly available by the Ambassador.

FMT will provide Ambassadors with pre-approved logos and swipe content for marketing use. FMT encourages Ambassadors to use their own campus photography in their social posts. However, they must have permission to use images with other students.

Restrictions: Ambassadors may not modify, misuse, or distribute any intellectual property in a way that could harm FMT's reputation or brand integrity, as determined by FMT.
Ownership: All intellectual property of FMT shall remain the property of FMT, and nothing in these terms and conditions shall be construed as transferring the same to the Ambassador. Any intellectual property that the Ambassador develops related to FMT or during the course of the Ambassador's services to FMT shall be owned by FMT, and the Ambassador hereby assigns the same to FMT.

6. Confidentiality and Data Protection
Confidential Information: Ambassadors agree to maintain the confidentiality of any proprietary or sensitive information provided by or regarding FMT and not to use the same in any way detrimental to FMT or its business.

Data Handling: Both parties must comply with applicable data protection laws regarding the handling, storage, and processing of personal information. The Ambassador will immediately comply with any directions or orders from FMT regarding the handling, storage, and processing of personal information.
Text Messages: FMT may contact Ambassadors via text message using the phone number Ambassadors provided when registering with FMT. Data rates may apply. Ambassadors may opt out of text messages by replying "Stop" to any text message sent by FMT or by emailing contact@fundmytextbooks.com.

7. Termination
Termination Rights: Either party may immediately terminate the ambassador relationship, for any or no reason, by providing written notice to the other party. Immediate termination will be deemed to occur if the Ambassador breaches these terms and conditions or engages in fraudulent or unethical behavior, as determined by FMT.
Post-Termination Obligations: Upon termination, the Ambassador must immediately cease using FMT's intellectual property and promotional materials and shall immediately remove any posts or other public-facing uses of the same. Any pending commission payments will be processed according to the terms outlined.

8. Disclaimers and Limitation of Liability
No Earnings Guarantee: FMT does not guarantee any level of earnings or results from participation in the Student Ambassador Program.
Liability Cap: FMT's liability for any claim arising from the ambassador relationship is limited to the total commissions paid to the Ambassador pursuant to the Student Ambassador Program.

9. Indemnification
Ambassador Responsibility: The Ambassador agrees to indemnify and hold harmless FMT from any claims, damages, or losses arising from its promotional activities, including any breach of these terms and conditions.

10. Modifications to Terms and Conditions
Right to Modify: FMT reserves the right to modify these terms and conditions at any time. Ambassadors will be notified of any changes, and continued participation in the Student Ambassador Program constitutes acceptance of the revised terms and conditions.

11. Governing Law and Jurisdiction
Applicable Law: These terms and conditions and the ambassador relationship shall be governed by and construed in accordance with the laws of the State of California.

12. Entire Agreement and Miscellaneous
Complete Understanding: These terms and conditions represent the entire agreement between the Ambassador and FMT regarding the Student Ambassador Program, superseding all prior communications regarding the same.
Severability: If any provision in these terms and conditions is deemed unenforceable, the remaining provisions shall remain in full effect.
Independent Contractor: Ambassador is an independent contractor of FMT, and the ambassador relationship not be construed to create any association, partnership, joint venture, employment, or agency relationship between the Ambassador and FMT for any purpose. Ambassador has no authority (and shall not hold itself out as having authority) to bind FMT and shall not make any agreements or representations on FMT's behalf. Ambassador will receive an IRS Form 1099 from FMT and shall be solely responsible for all federal, state, and local taxes.

1. Introduction

Fund My Textbooks, Inc. ("FMT," "we," "us," or "our") is committed to protecting the privacy of participants in the FMT Student Ambassador Program (the "Program"). This Privacy Policy explains how we collect, use, store, and share information when you register and participate as an Ambassador through the FMT Ambassador Portal, powered by iDevAffiliate (fundmytextbooks.idevaffiliate.com).

By registering as an Ambassador, you agree to the terms of this Privacy Policy. If you do not agree, please do not register or use the Ambassador Portal.

2. Information We Collect

When you register and participate in the Ambassador Program, we may collect the following types of information:

Registration Information: Your name, university email address (UC Davis email required), phone number, and any other information you provide when creating your Ambassador account.

Payment Information: Your Venmo account information, which is collected solely for the purpose of processing commission payments and bonuses. FMT does not store full financial account credentials.

Tax Information: If your total earnings exceed $600 in a calendar year, we will collect the information required to issue an IRS Form 1099, including your legal name, address, and taxpayer identification number.

Referral and Activity Data: Your unique referral link activity, including the number of students referred, referral signup dates, campaign creation dates, and commission amounts earned.

Communications: Records of emails, text messages, and other communications between you and FMT related to the Program.

Device and Usage Data: When you access the Ambassador Portal, we may automatically collect certain technical information, including your IP address, browser type, and pages visited within the portal.

3. How We Use Your Information

We use the information we collect for the following purposes:

- To verify your eligibility and register you as an Ambassador
- To track referrals, calculate commissions, and process payments
- To communicate with you about your account, program updates, and payment status
- To issue required tax documents
- To detect and prevent fraud or misuse of the Program
- To comply with applicable laws and regulations
- To improve the Ambassador Program and our platform

4. Text Message Communications

By providing your phone number during registration, you consent to receive text messages from FMT related to the Ambassador Program. Standard data rates may apply. You may opt out at any time by replying "STOP" to any text message from FMT or by emailing contact@fundmytextbooks.com.

5. How We Share Your Information

FMT does not sell your personal information. We may share your information in the following limited circumstances:

Service Providers: We work with third-party service providers, including iDevAffiliate, to operate the Ambassador Portal and track referral activity. These providers are authorized to use your information only as necessary to provide services to FMT.

Payment Processing: Your Venmo information is used solely to process your commission payments. FMT does not share your payment information with any third party other than as required to complete the transaction.

Legal Requirements: We may disclose your information if required to do so by law, court order, or government authority, or if we believe disclosure is necessary to protect the rights, property, or safety of FMT, our users, or others.

Business Transfers: In the event of a merger, acquisition, or sale of all or part of FMT's assets, your information may be transferred as part of that transaction. You will be notified of any such change.

6. Data Retention

We retain your personal information for as long as your Ambassador account is active and for a reasonable period afterward as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Tax records and payment information may be retained for a minimum of seven years in accordance with IRS requirements.

7. Your Rights and Choices

You have the right to:

- Access the personal information we hold about you
- Request correction of inaccurate or incomplete information
- Request deletion of your personal information, subject to legal retention requirements
- Opt out of non-essential communications at any time

8. Security

FMT takes reasonable technical and organizational measures to protect your personal information from unauthorized access, use, or disclosure. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

9. Third-Party Platforms

The Ambassador Portal is powered by iDevAffiliate, a third-party affiliate tracking platform. Your use of the portal is also subject to iDevAffiliate's own privacy practices. FMT is not responsible for the privacy practices of third-party platforms. We encourage you to review iDevAffiliate's privacy policy separately.

10. Children's Privacy

The Ambassador Program is open only to individuals who are 18 years of age or older (or who have obtained parental or guardian consent as described in the Ambassador Terms and Conditions). We do not knowingly collect personal information from individuals under the age of 13. If we become aware that we have inadvertently collected such information, we will delete it promptly.

11. Changes to This Privacy Policy

FMT reserves the right to update this Privacy Policy at any time. We will notify registered Ambassadors of material changes via email or through the Ambassador Portal. Your continued participation in the Program after any update constitutes your acceptance of the revised policy.
